Výzva na prihlásenie pohľadávky zahraničným veriteľom v súlade s Nariadením (EÚ) 2015/848 zo dňa 20. mája 2015. Invitation to lodge a claim for foreign creditors accorging to the Regulation /EU/ No. 2015/848 of 20th May 2015 on insolvency proceedings.

V súlade s Nariadením Rady Nariadením (EÚ) 2015/848 zo dňa 20. mája 2015 ako správca dlžníka J - PLASTIK, s.r.o., IČO: 44 623 577, so sídlom Štefánikova 3499, Bardejov 085 01, Slovensko (ďalej ako „Dlžník"), Vám oznamujeme, že uznesením Okresného súdu Prešov sp. zn. 5R/2/2018 zo dňa 04.05.2018 bola povolená reštrukturalizácia dlžníka. Toto uznesenie Okresného súdu Prešov bolo zverejnené v Obchodnom vestníku č. 91/2018 zo dňa 14.05.2018. Reštrukturalizácia sa považuje za povolenú dňom 15.05.2018. According to the Direction of the EU No. 2015/848 of 20th May 2015, as the trustee of the Debto J - PLASTIK, s.r.o., IČO: 44 623 577, Štefánikova 3499, Bardejov 085 01, Slovensko (hereinafter the „Debtor“), I am obliged to inform you that by Resolution of the District Court in Prešov No. 5R/2/2018 dated on 04th of May 2018 the restructuring of the Debtor was permitted. This resolution of the District Court Prešov was published in Commercial Bulletin No. 91/2018 dated on 14/05/2018. The restructuring is considered to be permitted on 15th of May 2018.

V zmysle zákona č. 7/2005 Z. z. o konkurze a reštrukturalizácii (ďalej len „ZKR") veritelia dlžníka sú povinní v lehote 30 dní od povolenia reštrukturalizácie prihlásiť svoje pohľadávky v jednom rovnopise u správcu na adrese: JUDr. Peter Novosad, LL.M., Masarykova 16, 080 01 Prešov, Slovenská republika. Prihláška musí byť podaná na predpísanom tlačive. V prihláške sa vždy uvedie meno, priezvisko a bydlisko alebo názov a sídlo veriteľa a dlžníka, právny dôvod vzniku pohľadávky, poradie uspokojenia pohľadávky a suma pohľadávky; prihláška musí byť datovaná a podpísaná veriteľom. Rovnakým spôsobom uplatňujú svoje pohľadávky aj veritelia pohľadávok, ktorých vznik je viazaný na splnenie podmienky, pričom sa uvedie podmienka, od ktorej závisí vznik pohľadávky, a aj veritelia pohľadávok zabezpečených vecným právom, ktorí v samostatnej prihláške uvedú druh, poradie, a právny dôvod vzniku vecného práva spolu s určením majetku, ktorým je zabezpečená a sumu, do ktorej je zabezpečená. Pohľadávka sa uplatňuje v mene euro. K prihláške sa pripájajú listiny preukazujúce údaje uvedené v prihláške. Veriteľ, ktorý je účtovnou jednotkou, v prihláške uvedie vyhlásenie, či o pohľadávke účtuje v účtovníctve alebo dôvod prečo o pohľadávke neúčtuje. Ak veriteľ nemá na území Slovenskej republiky bydlisko alebo sídlo alebo organizačnú zložku podniku, v prihláške je povinný uviesť zástupcu na doručovanie písomností, ktorý má bydlisko alebo sídlo na území Slovenskej republiky. Vzor tlačiva prihlášky je k dispozícii na internetovej stránke www.justice.gov.sk. Pri prihlasovaní prihlášok veriteľov, ktorí majú zvyčajné miesto pobytu, trvalé bydlisko alebo registrované sídlo v iných členských štátoch Európskej únie ako v Slovenskej republike sa postupuje v súlade s Nariadením (EÚ) č. 2015/848 zo dňa 20. mája 2015 o konkurznom konaní. According to the Act No. 7/2005 Coll. Bankruptcy and Restructuralization Act creditors of the Debtor have to lodge their claims in the time period of 30 days beginning with the permission restructuring in one original to the trustee of the restructuring to the address: JUDr. Peter Novosad, LL.M., Masarykova 16, 080 01 Prešov, Slovak republic. The application must be lodged on the prescribed form. The application of claim shall provide information about the name, surname and the address of the firm and the seat of the creditor and of the Debtor, the legal cause of the claim, ranking of the satisfaction of the claim from the Debtor's estate and the amount of the principal; the application of claim has to be dated and signed. Creditors whose claims depend on the fulfillment of certain conditions lodge their claims in the same way. They also state in the registration form the condition on which the claim is dependent. Creditors with claims secured with securities also fill in the registration form which has to provide information about the object to which the security is tied. The claim has to be lodged in currency EUR. Documents proving the information provided in the application of claim have to be enclosed to the application of claim. Creditor who is the accounting entity in the application form include a statement indicating whether a claim is recorded in the accounts of the extent or the reasons why the claim does not in the account books. In case the creditor does not have a seat or an address or a branch office in the Slovak Republic a representative with an address or a seat in the Slovak Republic has to be stated. The lodgment form can be found on the website www.justice.gov.sk. When lodging their claims the creditors having the habitual residence, domicile or registered office in another EU Member State than the Slovak republic must proceed according the Regulation (EC) No. 2015/848 on insolvency proceedings.

Na prihlášky, ktoré nebudú spĺňať zákonom stanovené podmienky alebo nebudú doručené v stanovenej lehote sa neprihliada. Správca nie je povinný vyzvať veriteľa na doplnenie alebo opravu neúplnej alebo nesprávnej prihlášky. Prihlášku možno opraviť alebo doplniť len tak, že sa pôvodná prihláška nahradí u správcu novou prihláškou, a to len do uplynutia lehoty na prihlasovanie pohľadávok. Any application of claim that will not meet legal requirements or lodgment of claim which will not be delivered in time will not be considered as claims. The trustee do not have the duty to notify the creditor to amend or to correct the incorrect or the incomplete lodgment of claim. Application form may be corrected or amended only by replacing the original application form by a new application form, but only into the deadline for logging claims.
